Smythe Puryear & Robertson is a boutique association of

Rights, Consumer and Commercial Debt Collections and Judgment Recovery.
Clients include Fortune 500 companies as well as small businesses, and the
scope of representation is always tailored to assert clients' legal rights
in the most cost-effective manner given their resources and needs.
Commercial and Business Litigation: Smythe Puryear & Robertson represents financial institutions
and a range of businesses across the spectrum in all facets of commercial
litigation, including sales and lease disputes; banking litigation involving negotiable instruments, bank deposits and collections, and letters
of credit disputes; and secured transactions (Article 9) litigation,
including perfection and priority disputes. In addition,
Smythe Puryear & Robertson represents clients in a variety of business related
torts, including claims of business interference, fraud,
misrepresentation, trademark and trade name infringement, and
fiduciary duty claims.
Construction and Surety: Smythe Puryear & Robertson represents Contractors and
Subcontractors, builders, developers, suppliers, owners, architects and
engineers, and well as sureties on bonded projects, in all facets of
construction litigation. A substantial portion of the group's practice
focuses on Mechanic's and Materialmen's lien claims and bond claim litigation.
Creditors' Rights: Smythe Puryear & Robertson represents Creditors throughout all aspects of the
Bankruptcy Process, including Preference and Avoidance litigation,
Discharge and Dischargeability objections, and claims enforcement.
An active role is taken in the bankruptcy process, from claims
negotiation to plan confirmation, and clients are advised of all
remedies including the use of involuntary bankruptcies and
substantive consolidation of related debtors.
Collections and Judgment Recovery: Smythe Puryear & Robertson represents and counsels clients in all facets
of credit transactions and Receivables Management, including
pre-default lender counseling on Lender Liability Law and Creditor
Rights, and voluntary workouts. Post-default, the attorneys
undertake judicial and non-judicial foreclosures, and a variety of
aggressive yet cost-effective measures to preserve adequate
security, including pre-judgment writs of attachment and other forms
of injunctive relief, creditor assignments and lien preservation.
Clients are represented aggressively throughout any necessary
litigation to enforce claims, and in addition to all standard
post-judgment remedies (garnishments, executions, levies, etc.),
aggressive investigation is made to uncover fraudulent conveyances
and pierce the corporate veil, where debtors seek to hide assets. |
