Philip L. Robertson
Philip Robertson primarily practices
in the areas of commercial, creditor’s rights, surety,
construction, and bankruptcy litigation.
Mr. Robertson has extensive experience
representing regional and national Sureties and Insurers in
surety and construction claims investigation and litigation,
as well as work-outs. He has routinely assisted clients in
connection with construction and surety claims, lien
litigation, surety and fidelity indemnity actions, surety
interpleader, and CGL defense.
His bankruptcy litigation practice
focuses on assisting creditors in every stage of the
proceedings, including issues of stay relief, preference
defense, claims preparation, objections to discharge, Plan
objections, and negotiation and creation of DIP surety credit
facilities. He has represented local and national clients in
the multi-million dollar litigation of several high profile
bankruptcy cases, including K-Mart, Enron, Encompass Services,
and Farmland, Inc.
In addition, Mr. Robertson focuses on
assisting creditors in commercial collections and judgment
enforcement. Mr. Robertson also represents clients in all
aspects of commercial litigation including business and
contract disputes, secured transactions, UCC foreclosures,
commercial landlord and tenant, fraudulent conveyances, and
recovery of property.
Not just a litigator, Mr. Robertson’s
transactional practice includes formation and negotiation of
contracts, leases, creation of liens and secured interests,
preparation of UCC filings, preparation of deeds of trust and
related instruments, sales, and registration of trademark
assignments.
Admitted to practice in all state and
federal courts in Tennessee, Mr. Robertson also regularly
assists out of state attorneys by acting as local counsel.
